These Terms of Service (“Terms”) govern your access to and use of our desktop applications, browser extensions, websites, and related AI-powered services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

  1. Description of Service — textBoi provides AI-powered translation, sentence correction, rewriting, and explanation tools powered by OpenAI Enterprise API. Under this enterprise arrangement, no user data is used for model training, retention, or profiling by OpenAI. All requests are transmitted securely via encrypted (TLS 1.2+) connections.
  2. Accounts & Eligibility — Certain features require registration and authentication. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. Creating an account on behalf of another person or entity requires proper authorization.
  3. Fair Use & Restrictions — You agree not to abuse, automate, or exceed reasonable usage limits (e.g., API requests or token quotas). You may not:
    • Engage in scraping, resale, or redistribution of the Service or its outputs;
    • Attempt to reverse-engineer or extract any source code or model logic;
    • Use the Service in a manner that infringes, violates, or misappropriates the rights of others;
    • Bypass security mechanisms, rate limits, or access controls.
    Violation of this section may result in suspension or termination without refund.
  4. Subscription, Billing & Refunds
    1. Recurring Billing — Access to paid features (“Paid Services”) requires a valid payment method. By subscribing, you authorize textBoi, Inc. and its billing partners (e.g., Stripe, Paddle, Toss) to automatically charge your selected payment method on a monthly, annual, or pay-as-you-go basis, as applicable to your plan. Billing begins on the day you activate or access Paid Services, even if you have not yet fully configured all features. For usage-based plans, a pre-authorization hold may be applied to your payment method to cover accrued usage fees.
    2. Price Changes — We reserve the right to modify subscription fees or pricing at any time, with at least 30 days’ prior notice via email or in-app notification. Revised fees take effect in the next billing cycle unless otherwise stated.
    3. No Refunds — ALL FEES ARE NON-REFUNDABLE. You will be charged in full for the subscription term in which you cancel, and no refunds or partial credits will be issued for unused time, tokens, or quota. Following cancellation, access continues until the end of your current billing cycle.
    4. Taxes — All fees are exclusive of taxes or levies imposed by applicable authorities. You are responsible for all such taxes except those based on textBoi, Inc.’s net income.
  5. Ownership of Content — You retain ownership rights to the text or content you submit (“Input”) and to the generated results (“Output”). textBoi, Inc. assigns to you all rights, title, and interest it may have in such Output, to the extent permitted by law. Because of the probabilistic nature of AI systems, similar or identical Output may be generated for other users.
  6. Accuracy & Use Disclaimer — AI-generated content may contain inaccuracies or omissions. You agree not to rely solely on any Output as factual or professional advice. textBoi, Inc. disclaims liability for decisions made based on AI-generated results.
  7. Intellectual Property — All trademarks, software, designs, and related materials are the property of textBoi, Inc. or its licensors. You may not copy, modify, reverse-engineer, or redistribute any portion of the Service without prior written consent.
  8. Data Protection & Security — All user data is processed under enterprise-level security standards. Data is encrypted in transit (TLS 1.2+) and at rest with restricted access controls. No text or Input you provide is stored or used for model training, advertising, or profiling.
  9. Third-Party Services — The Service may rely on third-party APIs (e.g., OpenAI, Supabase, Stripe, Cloudflare), governed by their own terms. textBoi, Inc. is not responsible for their performance, uptime, or data practices.
  10. User Feedback — By submitting feedback or suggestions, you grant textBoi, Inc. a perpetual, worldwide, royalty-free license to use or incorporate it into our products without obligation or compensation.
  11. Service Modifications & Availability — We may update or modify AI models (e.g., GPT-4.1 → GPT-5) to improve reliability. Maintenance or outages may occur without notice. We are not liable for interruptions or data loss from such updates.
  12. Termination — We may suspend or terminate your access if you violate these Terms, abuse the Service, or engage in fraudulent activity. Upon termination, your license ceases immediately; data may be retained only as legally required.
  13. Limitation of Liability — The Service is provided “as is” and “as available.” textBoi, Inc. makes no warranties of any kind, express or implied. To the maximum extent permitted by law, our aggregate liability will not exceed the total amount paid by you in the preceding 12 months.
  14. Governing Law & Dispute Resolution — These Terms are governed by the laws of Delaware, United States. Before formal proceedings, you agree to contact support@textboi.ai for informal resolution. If unresolved within 30 days, disputes will be submitted to binding arbitration in Delaware under AAA rules, in English, on an individual basis.
  15. No Class Actions — You may bring claims only in your individual capacity; class or batch arbitration is expressly disallowed.
  16. Compliance & Sanctions — You represent that you are not located in, or under the control of, any U.S.-sanctioned country or entity. You agree to comply with all applicable export and anti-bribery laws.
  17. Assignment — textBoi, Inc. may assign its rights under these Terms to affiliates or successors. You may not assign without prior written consent.
  18. Amendments — We may update these Terms from time to time. If material changes occur, we will notify you via email or in-app at least 30 days in advance. Continued use after updates constitutes acceptance of the revised Terms.
